*Jade Love Designs Commission Contract:*
( Upon entering into a commission project with Jade Love Designs, the client agrees to adhere to this contract and acknowledges all policies therein. No signature required. )
*PLEASE NOTE: all artwork will be provided by the artist to the client, in digital format only. The client will not receive any physical products.
*The Client will receive:
One Preliminary Sketch/Line Art for Client’s approval. ( This is the Initial Revisions Stage: any changes to the overall artwork can be requested during this stage. )
One Final Sketch ( after initial revisions have been made ) for client’s approval.
One Color Concept ( the final revised sketch with base colors added ) for client’s approval. ( This is the Final Revision Stage: changes to the color concept may be requested at this stage. PLEASE NOTE: Any revision request requiring significant changes or reflecting a new direction to the project will require an additional fee and an updated contract to be determined and agreed upon by both parties. )
One Final Digital file of the completed artwork in the format of the client’s choice ( PNG, PDF, JPEG, etc.) Files will be rendered at 300 DPI for high-quality images. All digital artwork will be rendered in the RGB color profile. ( suitable for screens/digital display) If the Client wishes to have a CMYK ( suitable for printing ) version of the final file instead of, or in addition to the standard RGB format, this must be expressed upon signing of this contract. Requests for changes to the color profile after the initial contract is signed will incur an additional fee of $25.00 USD. If the Client requires the artwork in a specific size, this must also be expressed upon signing of this contract.
*Client agrees to approve artwork submissions and give feedback within 2 days of receipt. Failure to give timely responses will require an extension to the final art delivery, or an additional rush fee to meet the original end date. Rush fees will be determined by the Artist depending upon the amount of work left, and the time remaining to complete the project. If the Client does not agree with the proposed rush fee, they may choose an extension instead.
*Watermarks: All artwork will be watermarked by Jade Love Designs. The client agrees not to crop out, remove, or otherwise alter the artist’s watermark when displaying the artwork or using it for business purposes.
*Alterations: Alterations to the artwork are not permitted without prior written consent from the Artist. The Client agrees not to make any changes to the artwork. Any images shared with the Client including, but not limited to, Preliminary sketches, line art, and color concept images, may not be used or shared by the Client without prior express permission from the Artist. The licensing rights in this agreement extend only to the final, watermarked artwork, not sketches or line art.
*When commissioned artwork is created based on the Client’s intellectual property such as book characters and scenes from books, the Client will have exclusive rights to the final artwork, meaning the Artist may not license the final artwork to other parties without express written permission from the Client.
***Please Note: this licensing agreement does not give the Client ownership of the artwork. The Artist Jade Love Designs retains the copyright ownership to ALL artwork created including sketches, concept art, line art, etc.***
Upon final payment and the conclusion of this contract, Jade Love Designs gives express permission for _________________ to use the final watermarked artwork for business purposes including promotion, marketing, prints, social media, Patreon and bookmarks. Any usage rights not explicitly stated here are reserved to the Artist. Any additional use beyond the express use granted, will require the arrangement of a separate fee and contract.
The Client will make every effort to include credit to the Artist in any promotion of the work.
The Artist reserves the right to display all contributions to the work, including preliminary sketches, in their portfolio and social media platforms, and to submit the work to design competitions.
*About Shipping :
Physical items ship via USPS or UPS First Class, Media Mail or Priority Mail service. Priority shipping includes a tracking number, and standard shipping insurance (typically $50)
Please note that Jade Love Designs is not responsible for lost or stolen packages. Shipping is only available within the USA at this time.
*About Returns/Refunds :
Jade Love Designs does not offer refunds or exchanges for custom orders or commission services as they cannot be re-sold once they’re customized to your specifications. In order to ensure customer satisfaction for custom commissions, Jade Love Art will provide progress photos for client approval prior to the completion of the piece.
